In these Terms, we, us and our mean Strategic Software Studios Pty Ltd. You and your mean the person accessing or using the Website.
By accessing or using the Website, you agree to these Terms. If you do not agree, you must not use the Website.
2. Other terms and policies
These Terms govern use of the Website.
Purchases made through the Website are also governed by our Website Terms of Sale.
Downloading, installing or using the Obscured Media software is governed by our Software Licence Agreement.
Refunds, repairs, replacements and other consumer remedies are addressed in our Refund, Repair, Replacement and Remedy Policy.
Our handling of personal information is explained in our Privacy Policy.
An approved affiliate may also be subject to a separate Affiliate Program Agreement.
If a more specific document applies to a particular activity, that document applies to that activity. Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.
3. Eligibility and authority
You must use the Website lawfully and be legally capable of accepting these Terms.
A person under 18 may browse general information with appropriate parental or guardian supervision. A purchase, customer account or affiliate application must be made by an adult or an authorised representative.
If you use the Website for an organisation, you represent that you are authorised to act for that organisation.
4. Purpose of the Website
The Website may provide:
- information about Obscured Media;
- product descriptions, pricing and system requirements;
- software downloads and updates;
- software licence purchasing, delivery and recovery;
- customer support and product documentation;
- customer or affiliate portal functions;
- product announcements and marketing communications; and
- security, compatibility and release information.
The Website does not provide legal, financial, forensic, professional data-recovery or cybersecurity-certification advice.
Security and privacy information describes the design and tested behaviour of the applicable released product. It is not a promise that every form of unauthorised access, hardware failure, corruption, user error, malicious software or future security vulnerability can be prevented.
Roadmaps, prototypes, proof-of-concept material, beta demonstrations and statements about possible future features are informational only. A future feature is not included in a purchase unless the applicable product page or order confirmation expressly says that it is included.
5. Accounts and portal access
Some Website functions may require an account, emailed access link, order identifier or other authentication.
You must provide accurate information and keep your contact details current.
You are responsible for taking reasonable steps to protect your account credentials, email account, authentication links and devices. You must not provide access to an unauthorised person.
Please contact support@obscured.media promptly if you suspect unauthorised account access, an exposed authentication link or misuse of your portal.
We may require reasonable verification before changing an account email address, reissuing a licence file, disclosing transaction information, changing payment details or processing another sensitive request.
We will not ask for your Obscured Media application password, recovery key or private media as proof of account ownership.
You are not responsible for unauthorised activity caused by our failure to use reasonable security or another matter for which responsibility cannot lawfully be placed on you.
6. Permitted use
You may use the Website for lawful personal or internal business purposes connected with evaluating, purchasing, downloading, licensing, learning about or obtaining support for Obscured Media.
You may print or save reasonable copies of public legal documents and product documentation for your own records and use, provided that copyright and proprietary notices remain intact.
You may link to a public page in a fair and lawful way that does not falsely imply endorsement, partnership, approval or affiliation.
Use of our logos, banners, affiliate links, screenshots or marketing materials is subject to any specific permission, affiliate agreement and brand rules supplied with those materials.
7. Prohibited conduct
You must not use the Website to:
- break any law or facilitate unlawful conduct;
- infringe another person’s intellectual property, privacy, confidentiality or other rights;
- engage in fraud, deception, abuse, harassment or harmful conduct;
- gain or attempt to gain unauthorised access to an account, licence-generation system, payment system, source code, administrative function, database or connected infrastructure;
- introduce malware, malicious code, destructive data or a process intended to impair or disrupt the Website;
- generate excessive automated requests, denial-of-service traffic or other traffic intended to overload the Website;
- bypass access controls, forge requests, manipulate prices, generate unauthorised licence files or test stolen payment credentials;
- manipulate affiliate attribution, create fraudulent referrals or falsely claim a commission;
- use bots, scrapers, crawlers or automated extraction tools, except for ordinary search-engine indexing, accessibility tools or use we have authorised in writing;
- copy, frame, mirror, republish, sell or commercially exploit a substantial part of the Website or its documentation without permission;
- remove legal notices or obscure ownership or attribution;
- impersonate another person or falsely represent that you act for us;
- submit a fabricated review, false complaint, false security report or fraudulent refund request; or
- interfere with the security, integrity or ordinary operation of the Website.
Security researchers must follow any Vulnerability Disclosure Policy we publish. If no policy is available, written authorisation must be obtained before testing beyond ordinary use.
8. Intellectual property
We or our licensors own the Website, the Obscured Media software, text, designs, graphics, videos, documentation, code, databases, logos, trade marks and other materials, except where content is identified as belonging to another party.
These Terms do not transfer ownership of any intellectual property to you.
“Obscured Media”, its logos and related identifiers must not be used in a domain name, product name, social-media identity, paid-search campaign or advertisement in a way that falsely suggests endorsement, partnership or affiliation.
Third-party names, logos and products remain the property of their respective owners. Reference to a third party does not necessarily mean that the third party sponsors or endorses Obscured Media.
9. Downloads
You should download Obscured Media only from our official Website or another source that we expressly identify as authorised.
You should verify the publisher, digital signature, version and any checksum we publish before installing a download.
Downloads and use of the software are subject to the Software Licence Agreement and published system requirements.
You are responsible for maintaining reasonable operating-system, browser and device security. We remain responsible for our own legal obligations and for defects in an official download to the extent required by law.
10. User submissions
The Website may allow you to submit support messages, reviews, comments, suggestions, diagnostic bundles, affiliate applications or other material, collectively referred to as Submissions.
You retain ownership of your Submissions. You give us a non-exclusive, royalty-free permission to host, copy, review, use and communicate a Submission only as reasonably necessary to:
- operate the Website;
- provide the service or support you requested;
- administer the relevant account, purchase or program;
- comply with law;
- investigate security, fraud or misuse; and
- improve our products and documentation.
You must have the right to provide a Submission. A Submission must not contain unlawful material, malware, another person’s confidential information or personal information that you are not authorised to disclose.
Do not submit your Obscured Media application password, recovery key or private media files. Avoid including sensitive filenames, thumbnails, folder paths or screenshots. Contact us first where sensitive material appears genuinely necessary for a support matter so that a safer method can be considered.
We may remove, quarantine or refuse a Submission that is unlawful, unsafe, abusive, excessively sensitive, misleading, irrelevant or inconsistent with these Terms.
General product feedback and suggestions may be used without payment, but this does not give us ownership of your private media, confidential information or personal information.
11. Reviews and testimonials
A review or testimonial must reflect a genuine experience and disclose any material incentive, affiliate relationship, free licence or other benefit.
We may moderate reviews for unlawful content, privacy, abuse, spam, irrelevance or authenticity. We will not suppress a genuine negative review merely because it is critical.
We will not materially alter the meaning of a review without the author’s agreement.
We will not use a customer’s name, image, business name or statement in marketing as a testimonial without the permission required by law.
12. Third-party websites and services
The Website may link to third-party websites or services, including payment, email, support, hosting or software-distribution providers. Linking to a service is not the same as embedding it: no third-party code, font or tracker runs on this Website (see section 15).
A link or integration does not mean that we control or endorse every statement, product, security practice or privacy practice of the third party.
Your use of a third-party service may be governed by that provider’s own terms and privacy policy.
We remain responsible for our own conduct and cannot rely on this clause to exclude a responsibility that cannot lawfully be excluded.
13. Website availability and changes
We take reasonable steps to keep the Website, checkout, downloads and licence-delivery functions available and secure. We do not guarantee uninterrupted or error-free availability.
We may temporarily restrict a Website function to perform maintenance, deploy an update, respond to a security incident, prevent fraud or comply with law.
We may correct, update, withdraw or replace Website content. Changes to general Website content do not retrospectively alter an accepted purchase or remove an accrued consumer right.
A Website outage does not, by itself, delete media stored locally by a customer. The functions available in the installed application during an outage depend on the applicable licence and released product design.
14. Product information and accuracy
We take reasonable steps to make product descriptions, pricing, compatibility information and legal documents clear and accurate.
Technical information may need to be updated as operating systems, codecs, hardware, third-party components and network environments change.
You should review the current system requirements and compatibility information before purchasing or installing the software.
Nothing in this section permits misleading or deceptive conduct or removes any right arising because a product was materially different from its description.
15. Privacy, cookies and communications
We handle personal information in accordance with our Privacy Policy.
This Website sets no cookies and runs no analytics. The shop and customer portal at go.obscured.media run on separate infrastructure and do set cookies necessary for checkout, account sessions, security and affiliate attribution; blocking those may prevent checkout or account access from working. Section 11 of our Privacy Policy sets this out in full.
Service communications may include receipts, licence delivery, account notices, security warnings, expiry notices, critical update information and support responses.
Marketing communications will be sent only where permitted. They will identify the sender and include a functional unsubscribe method.
16. Suspension or restriction of access
We may proportionately restrict or suspend Website or portal access where reasonably necessary to:
- protect an account, customer or system;
- investigate credible fraud, malicious conduct or a security incident;
- comply with law or a lawful direction;
- prevent material harm; or
- respond to a material breach of these Terms.
Where appropriate, we will provide notice, explain the reason and give you a reasonable opportunity to respond or remedy the issue.
We will not suspend an account merely because a person makes a good-faith complaint, requests a lawful remedy, posts a genuine review or exercises a consumer right.
Any effect on a purchased software licence is governed by the Software Licence Agreement and Website Terms of Sale.
17. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies:
- a consumer guarantee;
- a right or remedy that cannot lawfully be excluded;
- liability for fraud or wilful misconduct; or
- any other liability that cannot lawfully be limited.
To the extent permitted by law, general Website content is provided for information and does not constitute professional advice.
18. Liability
This section applies only to the maximum extent permitted by law.
We are responsible for loss to the extent that it is caused by our breach, negligence or failure to comply with a non-excludable obligation.
Subject to those obligations, we are not responsible for loss caused solely by:
- unlawful or prohibited use of the Website;
- credentials or authentication links that you knowingly disclose to an unauthorised person;
- malicious material that you submit;
- a third-party website or service outside our reasonable control; or
- your failure to follow a clear and reasonable security warning.
Where we caused or contributed to a loss, responsibility will be assessed according to applicable law.
19. Complaints and security reports
For general enquiries, Website complaints, account issues and security reports, contact:
Please provide enough information for us to identify and assess the issue, but do not include your application password, recovery key or private media.
Nothing in these Terms prevents you from contacting Consumer Affairs Victoria, another applicable consumer body, a regulator, court or tribunal.
20. Changes to these Terms
We may update these Terms by publishing a new version and effective date.
A change applies prospectively. We will not use an updated Website term to retrospectively impose an undisclosed charge, alter an accepted purchase or remove an accrued right.
Where a material change affects an existing account or continuing Website service, we will take reasonable steps to notify affected users.
21. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to courts and tribunals with jurisdiction, subject to any mandatory right you may have to bring a claim in another jurisdiction.
22. General provisions
If a provision of these Terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary. The remaining provisions will continue.
A delay in exercising a right does not waive that right.
These Terms do not create an employment, agency, partnership or joint-venture relationship between you and us.
